3. Purpose and scope
3.1. Purpose
These Terms of Purchase (hereinafter, the "Terms") govern the relationship between the User and HabloHack in the purchase of subscription Plans. Their acceptance is a prior and essential requirement for completing any purchase on the Platform.
These Terms are supplemented by the Privacy Policy and the Cookies Policy, which form an integral part of the applicable legal framework.
3.2. Territorial scope
hablohack.com is available for the purchase of Plans by persons from any country. Prices are shown in euros, unless otherwise indicated in the future depending on the billing country.
3.3. Capacity to contract
To purchase a paid Plan you must be at least 14 years old and have sufficient legal capacity under the laws of your country of residence. If you are between 14 and 18 years old, purchasing the Pro Plan requires that payment be made with the authorization and payment method of your parent or legal guardian.
3.4. Validity
These Terms are valid indefinitely and apply to all purchases made on the Platform. We reserve the right to modify them in accordance with section 14. The version in force at the time of each purchase is the one applicable to that subscription.
4. Description of the service and plans
As of the date of this document, HabloHack offers two Plans, described in more detail on the pricing page:
- Free: to discover the method and start reading. Includes access to starter stories, basic vocabulary saving, and an essential view of your progress. At no cost.
- Pro: for those who want to use HabloHack daily. Includes the full catalog with a higher cadence of stories, a deeper study flow, and priority access to product improvements. Price: 6,99 €/month, billed annually (59,88 € per year).
Before confirming payment, you will be shown a summary including: features included, price, billing frequency, and applicable taxes.
5. Purchase process
5.1. Steps of the process
- Selection: you choose the Plan and the billing frequency.
- Buyer details: you complete your details, at a minimum name and email address.
- Payment: you select the payment method and complete the transaction through Stripe.
- Acceptance: you expressly accept these Terms via checkbox 1 and, optionally, you may subscribe to the newsletter via checkbox 2.
- Confirmation: we send you the purchase confirmation and charge summary by email.
5.2. Confirmation
The purchase is deemed completed at the moment we send you the confirmation email. If you do not receive it within a reasonable time, check your spam folder and, if you still cannot find it, contact us at info@hablohack.com.
5.3. Errors in the data
You are responsible for the accuracy of the details provided during the purchase. If you detect an error, report it as soon as possible to info@hablohack.com so that we can assess the correction options available.
5.4. Availability
The Platform is available for purchasing Plans 24 hours a day, except for interruptions due to technical maintenance or causes beyond our control.
6. Acceptance checkboxes
6.1. Checkbox 1. Acceptance of these Terms
Mandatory to complete the purchase. It implies that you have read, understand, and fully accept these Terms, the Privacy Policy, and the Cookies Policy.
Legal basis: performance of the subscription contract (Art. 6.1.b GDPR and Art. 1258 of the Spanish Civil Code). It does not constitute data protection consent for purposes other than managing the subscription.
6.2. Checkbox 2. Newsletter subscription
Voluntary and independent of the purchase. It implies your express consent to receive commercial communications about HabloHack news, content, and promotions.
You may revoke it at any time using the unsubscribe link in each communication or by writing to info@hablohack.com with the subject line "UNSUBSCRIBE NEWSLETTER". Revocation does not affect the lawfulness of communications sent prior to it.
7. Prices, taxes, and billing
7.1. Prices
The prices of each Plan are those published on the pricing page at the time of purchase, expressed in euros and including, where applicable, VAT or another applicable tax according to your billing country.
The total price shown in the order summary is the final price you will pay, with no hidden additional charges.
If a price is published with an obvious typographical error, we reserve the right to cancel the affected purchase and offer you the option to purchase at the correct price or receive a full refund of the amount paid.
7.2. Payment methods
Payment is made exclusively through Stripe, which guarantees the security of the transaction through SSL/TLS encryption. We do not store your full payment method details on our systems.
Stripe has its own privacy and security policies. We assume no responsibility for the operation of its payment gateway.
7.3. Payment security
If we detect or suspect any anomaly or indication of fraud in a transaction, we reserve the right to cancel it for security reasons, informing you at the email address provided.
8. Automatic renewal and cancellation
This is the most sensitive section of the entire document for a subscription model and must be drafted with particular care given consumer protection regulations.
- Automatic renewal: unless you cancel before the renewal date, your subscription automatically renews at the end of each Billing period, charging the same Plan at the price then in effect.
- Prior notice: we will inform you, at least 30 days before each renewal, of the date and amount to be charged, particularly if the price has changed since your last purchase.
- How to cancel: you can cancel automatic renewal at any time from [your account section / subscription settings], with the same ease with which you purchased the Plan, without needing to call or write to anyone to complete the cancellation.
- Effect of cancellation: upon cancelling, you retain access to the paid Plan until the end of the Billing period already paid for. No refunds are made for the unused portion of the current period, unless applicable law provides otherwise. At the end of that period, your account automatically switches to the Free Plan.
9. Right of withdrawal
In accordance with Article 103, letter m), of Royal Legislative Decree 1/2007 (TRLGDCU), the 14-calendar-day right of withdrawal does not apply to the supply of digital content not provided on a tangible medium when performance has begun with your prior express consent, and acknowledging that you lose your right of withdrawal once the service begins.
During the purchase process we will ask for that express consent via a specific checkbox before granting you immediate access to the digital content. If you do not check that box, you may exercise the right of withdrawal within the 14 calendar days following the purchase, provided you have not started using the service.
To exercise withdrawal, where applicable, write to us at info@hablohack.com with the subject line "WITHDRAWAL" and attach proof of purchase. The refund, where applicable, will be made using the same payment method used, within a maximum period of 14 calendar days from when we confirm your right of withdrawal.
10. Price or plan changes
We may modify the prices or features of the Plans. If the change affects an active subscription, we will notify you with reasonable advance notice before it applies to your next renewal, and you may cancel in accordance with section 8 if you do not agree with the new price or terms.
11. Compliance, incidents, and support
If you detect a technical failure, a duplicate charge, or any incident with your subscription, contact us at info@hablohack.com as soon as possible. We will resolve incidents attributable to the Platform, assuming, where applicable, the corresponding refund or adjustment.
12. Intellectual property
All content on hablohack.com and the app — stories, illustrations, audio, texts, brand, design, and software — is owned by Ignacio Kleinman Ruiz or his legitimate licensors, and is protected by intellectual and industrial property regulations. Your subscription grants you a personal, non-transferable, non-exclusive license to use the content for your own learning, without the right to reproduce, distribute, or publicly communicate it.
13. Limitation of liability
We are liable only for damages we cause you through technical failures directly attributable to the Platform, for example duplicate charges or failures to access purchased content, provided you notify us as promptly as possible.
Neither party will be liable for failure to perform its obligations when this results from unforeseeable and unavoidable circumstances beyond its control (force majeure), including natural disasters, decisions by government authorities, or telecommunications infrastructure failures.
14. Modification of these Terms
We reserve the right to modify these Terms to adapt them to regulatory changes or changes in our service model. Changes will be notified to registered Users by email or via notice on the Platform with reasonable advance notice. Continued use after the changes take effect will imply their acceptance.
15. Governing law and jurisdiction
These Terms are governed by Spanish law, in particular Royal Legislative Decree 1/2007, Law 34/2002, and the Civil Code.
- Users resident in the European Union: may bring proceedings before the courts of their habitual place of residence, in accordance with Article 18 of Regulation (EU) 1215/2012.
- Users resident outside the European Union: the parties submit to the jurisdiction of the Courts and Tribunals of Madrid, waiving any other jurisdiction.
You may also seek an out-of-court resolution through the consumer dispute resolution bodies recognized in your country, available on the European Commission's portal: consumer-redress.ec.europa.eu/dispute-resolution-bodies.
16. Contact and complaints
- Email: info@hablohack.com
- Postal address: C/ Teresa Berganza, 76, 28200 San Lorenzo de El Escorial (Madrid, Spain)
We will provide you with official complaint forms if you request them. You may also file a complaint with the consumer authority of your Autonomous Community or, if you reside in another EU country, with the corresponding consumer protection authorities.
